Two divorce systems in the UAE — which one applies to you

The UAE now runs two parallel family-law systems, and knowing which governs your case changes everything about strategy, timing and outcome.

Muslim couples (Emirati or expatriate) are governed by the Personal Status Law — Federal Decree-Law No. 41 of 2024, in force since 15 April 2025. Non-Muslim expatriates are governed by the Civil Personal Status Law — Federal Decree-Law No. 41 of 2022, applied by the dedicated non-Muslim family courts since February 2023, which allows a straightforward no-fault divorce where neither spouse has to prove blame.

Choosing the right court — and knowing when your home-country law can be applied instead — is one of the first things we advise on.

Types of divorce we handle

  • Mutual-consent (amicable) divorce — the fastest and cheapest route when both spouses agree.
  • Contested divorce — where terms, finances or fault are disputed.
  • No-fault civil divorce for non-Muslim expats under the 2022 Civil Personal Status Law.
  • Khula — divorce initiated by a Muslim wife; under the 2024 law a judge can now grant it even without the husband’s agreement.
  • Recognition of an overseas divorce, and defending or enforcing foreign judgments in the UAE.

The divorce process in Dubai, step by step

Every case begins with an attempt at amicable settlement at the Family Guidance and conciliation stage. If that fails, the case moves to the court of first instance, and either side can appeal.

In practice we advise you on which law and court apply, try to settle terms — finances, property and children — in writing, file and represent you at hearings, and formalise the judgment and handle enforcement, including any residency or travel-ban issues that follow.

Money: settlement, maintenance and assets

A clean divorce is only half the job — the financial settlement is what protects you afterwards. We advise on spousal maintenance (nafaqa) and, for non-Muslims, on financial provision under the civil law; on splitting UAE and overseas assets, bank accounts and end-of-service benefits; and on the treatment of the family home and any jointly owned property.

Where a business or significant assets are involved, we coordinate early to prevent assets being moved before the court can act.

What about the children?

Custody and guardianship are decided separately from the divorce itself, and the rules changed significantly in 2025. How much does a divorce cost in Dubai?

It depends on whether the divorce is amicable or contested. A mutual-consent divorce is far cheaper and faster; a contested case with disputed finances or custody costs more. We give a clear fee estimate at your first consultation before you commit.

Can non-Muslims get divorced under their own civil law?

Yes. Since 2023, non-Muslim expats can divorce under the UAE Civil Personal Status Law (Federal Decree-Law No. 41 of 2022) on a no-fault basis — neither spouse has to prove wrongdoing. In some cases your home-country law can be applied instead.

How long does a divorce take in the UAE?

An amicable divorce can conclude in a few weeks. A contested divorce takes longer because it passes through conciliation, first-instance hearings and any appeal. We work to settle terms early to keep it as short as possible.

Can a wife file for divorce without the husband’s agreement?

Yes. A non-Muslim spouse can file unilaterally on a no-fault basis. A Muslim wife can seek Khula, and under the 2024 Personal Status Law a judge can grant it even if the husband does not agree.

Do I have to attend court in person?

Not always. Much can be handled by your lawyer under a power of attorney, and many steps are now online. We will tell you exactly which hearings, if any, need you present.

I got married abroad — can I still divorce in Dubai?
