How child custody works in the UAE (2025 update)
For Muslim families, the Personal Status Law (Federal Decree-Law No. 41 of 2024, in force since 15 April 2025) made two big changes. Custody now continues for both boys and girls until they turn 18 — previously it ended at 11 for boys and 13 for girls. And a child aged 15 or older can now express a preference about which parent to live with, which the court will respect unless it harms the child.
For non-Muslim expats, the Civil Personal Status Law (Federal Decree-Law No. 41 of 2022) treats the mother and father as having an equal right to joint custody until the child turns 18, after which the child chooses. Where parents cannot agree, the court decides on the best interests of the child.
Custody vs guardianship — the difference that catches parents out
These are two different things, and confusing them causes real problems. Custody (the day-to-day care of the child) and guardianship (decisions about schooling, travel documents, medical care and finances) can sit with different parents.
This is why a parent with custody can still be blocked from renewing a passport, changing schools or travelling abroad with the child without consent from the other parent. We make sure the order you get actually gives you the authority you need — not just the label.
Custody for expat and non-Muslim parents
Two changes matter most for the expat community. First, non-Muslim families are now handled under the civil law with its joint-custody-to-18 default. Second, under the 2024 reforms a non-Muslim mother is no longer automatically stripped of custody once a child passes early childhood — the court can keep the child with her on conditions it sets.
